Recent Delinquent Account Correspondence

Hello fellow owners.... this is a note from my desk to your desk......I just received copy of our delinquent Owners at Las Palmas.... As I am writing this note to you we have total of $128,870.22 in delinquent accounts. Condos total of 28 owners are delinquent $34,097.84 SBPH 7 units $35,340.12 18 Villa owner has a balance on their accounts of total of $59,432.26 ---------------------------------- $128,870.22 Total of 53 unit that is 32% of the owners that ows us money....... My suggestion to the Board is Contact our attorney in Mexico and start Collection Procedures by the Mexican law Immediately..... As per our legal counsel in Mexico we can Put a court lien and/or foreclose units with more than 2 fees in default as established by the Sonoran Condominium Law Articles 32 and 37. Also we can shot of the water to all these units. I am supporting our HOA fully in this effort to Collect all this delinquent accounts immediately to the fullest of Mexican Law. Our Las Palmas community can not afford to carry all this delinquent owners ..... they can pay their HOA dues on Credit card monthly or mail in a check before the first every month if they can not afford to pay every 3 months. Also don't forget to mark your calender for our annual Board meeting on the 21st of November 2009 There will be a vote for the 2 year and 3 year Board term...... Hi Dan, Did we ever get a committee set up to create a new fee structure? I was waiting for a new statement or some sort of communication. In the mean time, last week I went ahead and sent in the full ask amount ($1944) since I knew we were running low on funds. As of this payment, please note that I consider us up-to-date. With respect to Janna’s email, I don’t think the HOA should start legal action on everyone that’s considered delinquent by 2 fees. We all know based on the learning’s from the last HOA meeting that we have quite a mess on our hands. Perhaps at the next HOA meeting on Nov 21 we can discuss how we’re going to set things straight. Hi James,
Have not had a chance to go through my e-mails in the last couple of days. I sent another e-mail to you regarding fees just prior. I remember discussing with you putting together a group of representatives that included Graham and Jack to help us with canvassing villa owners so that they start paying fees and the board will work with them. I have had one phone meeting with Graham and let him know that I support a committee that he is involved in to help the board. He let me know that he would do what he could and I let him know that I as a board member would do what I could to support any changes needed for us to be in line with the state law. Since then we have not talked but we are making headway on the legal front. Our attorney is working on the legal changes and we should have results for our next meeting November 21,09. It is my goal to make fees and voting structure consistent with the State condominium laws. In the meantime until these legal changes are made the voted in fee structure for 2009 stands and the board must use all available avenues to collect. Our community must collect the fees from all owners in order to meet our financial obligations. I would appreciated if you could help me with this while I and the board continue to work on making the legal changes asap. It is my goal to have this done by the time of our meeting in November. In order for our HOA to function we have to have all owners may the fees that have been approved for 2009. This has to happen. At the same time any changes specifically changes that we need to make to be consistent with the State laws have to happen in a legal capacity and effective once they are completed. I do expect all owners to be current with their dues and am willing to listen to any owner that would like to work out a payment plan due to hardship reasons. Thanks Dan Dimovski 602 449-0576

There must be a problem with the Postal service because every quarter I recieve an invoice with our balance due along with the monthly break down of our unit fees from Shannon. I think that once the late HOA fees are collected (approx $128,000) the past due late chargers collected should be applied as a credit to all owners that make payments on time and the delinquint owners have to ride the Pirate ship full of kids
